## Key takeaways

- Since 15 January 2026, Meta's WhatsApp Business Solution Terms bar AI providers from the WhatsApp Business Platform when the AI is the primary thing they offer.
- Businesses that use AI to serve their own customers, such as support, order and booking bots, are not affected.
- The rule now differs by country: the European Commission, Italy's AGCM and Brazil's CADE have forced Meta to let rival assistants in, while the rest of the world is still under the ban.
- In the EEA the access rests on interim measures dated 9 June 2026, which Meta is appealing, so it can change when a final decision arrives.

Since 15 January 2026, Meta's WhatsApp Business Solution Terms have barred AI companies from offering a general-purpose assistant on the WhatsApp Business Platform. Businesses that use AI to serve their own customers are not affected. The ban does not hold everywhere: regulators in the European Economic Area (EEA), Italy and Brazil have forced Meta to let rival assistants in, and we found no final decision in any of those cases.

## What does Meta's AI provider rule say?

Meta's WhatsApp Business Solution Terms contain a clause headed "AI Providers". In plain terms, it bars providers and developers of AI technology, including general-purpose AI assistants, from using the WhatsApp Business Platform when that AI is the primary, rather than incidental or ancillary, thing they offer. Meta decides what counts, in its sole discretion.

The Italian competition authority quotes the clause in its [December 2025 decision](https://en.agcm.it/en/media/press-releases/2025/12/A576). Such providers are "strictly prohibited from accessing or using the WhatsApp Business Solution, whether directly or indirectly". The scope covers large language models, generative AI platforms, general-purpose assistants and "similar technologies" as Meta determines. On a plain reading, "indirectly" means that going through a reseller or a Business Solution Provider does not change the answer.

## When did the rule take effect?

The AI provider rule took effect on two dates, according to the [European Commission](https://ec.europa.eu/commission/presscorner/detail/en/ip_25_2896). It has applied since 15 October 2025 to AI providers new to WhatsApp, and it applies from 15 January 2026 to those already on the platform. Meta announced the policy in October 2025.

Meta says the Business API is meant for customer support and updates, and that people can use other chatbots outside WhatsApp ([TechCrunch](https://techcrunch.com/2026/01/13/brazil-orders-meta-to-suspend-policy-banning-third-party-ai-chatbots-from-whatsapp/)). Meta's own assistant, Meta AI, stays available on WhatsApp, as the Commission notes.

## What does the rule still allow?

WhatsApp's rule still allows businesses to use AI to serve their own customers. TechCrunch reports that the policy does not stop businesses from offering their own chatbots to customers. The Commission describes the allowed side as AI used for "ancillary or support functions, such as automated customer support".

So order tracking, booking, support and similar bots stay on the Business API. The line is drawn by what the AI is for, not by which model runs behind it. [Is your AI bot allowed on the WhatsApp Business API?](https://whasp.ai/blog/is-my-ai-bot-allowed-whatsapp-business-api) walks through the test with examples.

## Who left WhatsApp because of the rule?

OpenAI (ChatGPT), Perplexity and Microsoft (Copilot) announced that their WhatsApp assistants would stop, according to TechCrunch's report of 13 January 2026. The AGCM decision lists Luzia, Poke and Zapia among the other assistants present on WhatsApp. The dates, what happened to users' chats and who came back are in [What happened to ChatGPT, Copilot and AI assistants on WhatsApp](https://whasp.ai/blog/chatgpt-on-whatsapp-after-ban).

## Does the rule apply the same way in every country?

No. Meta's [pricing page for AI providers](https://developers.facebook.com/documentation/business-messaging/whatsapp/pricing/ai-providers) says AI providers may offer general-purpose assistants only where Meta is "legally required to permit this use case", and it lists the markets where that applies. The table shows the position on 19 October 2026, by the country of the user receiving the message.

| Users in | Status | Why |
|---|---|---|
| EEA except Italy (29 countries, including Iceland, Liechtenstein and Norway) | Allowed, no charge since 13 May 2026 | European Commission interim measures of 9 June 2026 |
| Italy | Allowed, no charge since 13 May 2026 | AGCM interim measures announced 24 December 2025 |
| Brazil | Allowed, charged per message since 11 March 2026 | CADE interim measure |
| Türkiye | Listed since 15 October 2026, no charge through at least 11 April 2027 | Legal basis not stated on Meta's page |
| Everywhere else | Barred when the AI is the primary offering | The terms as written |

## What did the Italian and EU regulators do?

Italy's competition authority (AGCM) and the European Commission each ordered Meta to let rival assistants back, on different timetables.

### Italy (AGCM)

The AGCM opened an investigation in July 2025 into Meta AI's integration in WhatsApp. On 25 November 2025 it widened the case to the new Business terms and opened an interim-measures procedure. On 24 December 2025 it announced interim measures: Meta must immediately suspend the terms as far as they have effects in Italy. The AGCM found that the terms "completely exclude" Meta AI's competitors.

Meta charged AI providers per message in Italy from 16 February 2026 and stopped on 13 May 2026.

### European Commission (EEA except Italy)

The Commission opened a formal antitrust case, AT.41034, on 4 December 2025. It sent a Statement of Objections in February 2026 and a supplementary one in April 2026. In March 2026 Meta let assistants back for a per-message fee, which the Commission said was, at first sight, in practice equivalent to the ban. Meta stopped charging in the EU and EEA on 13 May 2026.

On 9 June 2026 the Commission [ordered interim measures](https://ec.europa.eu/commission/presscorner/detail/en/ip_26_1276). Meta must restore access for third-party general-purpose assistants on the terms that applied before 15 October 2025, free of charge, within five working days, and keep it until the Commission adopts a final decision. Breaking the order can cost up to 10 percent of turnover. It is only the second time the Commission has used interim measures under Regulation 1/2003, after Broadcom in 2019.

### Brazil (CADE)

Brazil's competition authority CADE ordered the policy suspended in January 2026 after complaints from Luzia and Zapia. Its tribunal rejected Meta's appeal on 4 March 2026 and [upheld a daily fine](https://www.gov.br/cade/en/matters/news/cade-upholds-daily-fine-against-meta-and-whatsapp-for-failure-to-comply-with-interim-measure) of BRL 250,000 on 23 April 2026. Meta has charged AI providers per message in Brazil since 11 March 2026.

## What is still unresolved?

Four things are open as of 19 October 2026, and we say so rather than guess.

- **The Commission case.** The order is interim. The investigation into the merits continues and the Commission says it has no legal deadline. Meta [appealed to the EU General Court](https://www.slaughterandmay.com/recent-work/meta-on-its-appeal-against-the-european-commission-s-whatsapp-interim-measures-decision/) in August 2026. We found no ruling, and an appeal to that court does not by itself suspend a Commission decision.
- **Italy.** The decision says it can be challenged before the Lazio regional administrative court. We found no final AGCM decision and no court ruling.
- **Brazil.** The CADE inquiry was still pending when Zapia's CEO spoke on 9 October 2026, and Meta's page still lists a charge there.
- **Everyone outside these markets.** We found no regulator order elsewhere, so the terms stand as written.

## What should an AI agent builder do now?

An AI agent or companion builder has three routes, and the right one depends on where your users are.

1. **Serve EEA users on the Business API.** It is open and free today. It rests on interim measures that Meta is appealing, so keep a second channel ready.
2. **Keep AI inside a business service.** A support, order or booking bot stays allowed everywhere. [Put an AI agent on WhatsApp: every option](https://whasp.ai/blog/put-ai-agent-on-whatsapp) compares all the routes.
3. **Use a personal number.** Your own number with an open-source library puts the ban risk on you. A managed number such as whasp is a real personal WhatsApp account on a cloud phone that whasp runs. People text it first, each message arrives on your webhook, and one API call replies. See [pricing](https://whasp.ai/pricing) and the [docs](https://whasp.ai/docs).

A personal account is not a Business Platform account, so the clause above is not the rule that governs it. Personal accounts follow WhatsApp's general [Terms of Service](https://www.whatsapp.com/legal/terms-of-service), and numbers that behave like bots, above all ones that message strangers, get banned: that risk is real. whasp is built around it (users write first, paced sending, its own IP per number) and replaces a banned number at no cost, but chats do not move to the new one. Groups are not supported, and neither is bringing your own number. [Business API vs a personal number](https://whasp.ai/blog/whatsapp-business-api-vs-personal-number) sets the two side by side.

## Questions

### When did Meta's WhatsApp AI chatbot ban start?

The updated terms applied from 15 October 2025 to AI providers new to WhatsApp and from 15 January 2026 to those already on it. The 15 January 2026 date is the one most people mean.

### Does the WhatsApp AI chatbot ban apply in the EU?

Not at the moment. On 9 June 2026 the European Commission ordered Meta to restore free access for rival general-purpose assistants in the EEA except Italy, and Italy has its own order. Both are interim measures, not final decisions.

### Can a business still use an AI chatbot on the WhatsApp Business API?

Yes, if the AI serves the business's own customers, for example support, orders or bookings. The ban targets companies whose product is the AI assistant itself.

### Is Meta AI affected by the ban?

No. Meta AI is built into WhatsApp and was the one general-purpose assistant left available when the ban took effect.
