Terms of Service
Last updated: October 20, 2026
These terms cover whasp: the site, the dashboard and the API. “whasp”, “we” and “us” mean the operator of whasp. “You” means the company or person that opens an account. By using whasp, you accept these terms. If you accept them for a company, you confirm you can bind it.
What whasp is
whasp provides real personal WhatsApp numbers to companies that build AI companions, assistants and agents. Each number runs the regular WhatsApp app on a cloud phone we operate, behind its own IP. You get a send API and a webhook.
whasp is for business use. You must be at least 18 to open an account.
whasp is not WhatsApp
whasp is not affiliated with, endorsed by or sponsored by Meta or WhatsApp. WhatsApp is a trademark of Meta Platforms, Inc.
Automating the personal WhatsApp app is against WhatsApp’s terms. WhatsApp can ban any number at any time, without warning. We cannot prevent or reverse a ban. You accept this risk: a ban is not our breach.
Your account
You sign in with a link we email you, so keep that inbox secure. You are responsible for all activity on your account and API keys. Keep keys secret and revoke any key that leaks.
Numbers and bans
A number costs $49 per 30-day period. The number and its WhatsApp account stay with whasp: you cannot move them out.
When WhatsApp bans a number for good, we replace it at no cost for the rest of the paid period, as soon as a number is ready. The replacement keeps the same label, name, photo and end date.
The new number starts with no chats. We do not move conversations, and the new number cannot write first. Your own logic moves your users over, for example by sending them the new number’s link.
Prepaid balance and renewals
whasp runs on a prepaid balance in US dollars. You top up in the dashboard through our payment processor, by card, Apple Pay, Google Pay or crypto.
- Adding a number takes $49 from the balance at once. If setup fails, we credit it back.
- When a period ends and auto-renew is on, the next $49 comes from the balance and the number runs another 30 days.
- We email you when your balance will not cover upcoming renewals.
- If the balance cannot cover a renewal, the number stops at the end of its period. We may keep it running up to 3 days so you can top up. Renewing in that window keeps the original dates.
- You can turn off auto-renew or remove a number at any time. It works until its period ends, then retires. A retired number cannot be brought back.
Refunds
Unused balance is not refunded, unless the law requires it. A period that has started is not refunded, including when the number is banned (you get a replacement), when you stop it early, or when we suspend your account.
Messaging rules
- End users write first. A number only answers people who wrote to it. The API refuses to start cold chats.
- No spam and no cold marketing. Send only messages your users expect.
- Honor STOP. STOP and the other opt-out keywords block the chat automatically. Do not work around this. Other requests to stop, like “please stop”, are yours to catch and respect.
- Daily limit. Each number sends at most 1,500 messages in any 24 hours.
- Say it is an AI. Your users must know they are talking to an AI.
- Follow the law that applies to you and your users, including privacy and messaging laws.
Abuse and suspension
Not allowed:
- spam or bulk unsolicited messages;
- cold outreach to people who did not write first;
- illegal content or activity;
- impersonating anyone, including through a number’s name or photo;
- harassment or threats;
- anything meant to get numbers banned on purpose.
If you break these rules, we can suspend or close your account at once, without refunding your balance or any paid period. We may warn you first, but need not.
Your data and your users
You are the controller of your end users’ data. We process the messages passing through whasp on your behalf, as your processor. You must have a lawful basis for that processing. Our Privacy Policy explains what we keep.
whasp’s servers keep no message history. Store what you need from the webhook: we cannot send it again.
Service as is
whasp is provided “as is” and “as available”, with no uptime guarantee. Numbers can go offline or be banned. Messages can arrive late or not at all. As far as the law allows, we disclaim all warranties, express or implied. We may change features and limits.
Liability
As far as the law allows:
- Our total liability for all claims about whasp is limited to the fees you paid (the amounts taken from your balance) in the 30 days before the event that caused the claim.
- We are not liable for indirect or consequential losses, such as lost profits, users or data, including losses from bans.
- You will cover our costs from third-party claims caused by your messages or your breach of these terms.
Ending
You can stop at any time by turning off auto-renew (see above). To close your account, write to us.
Changes to these terms
We may change these terms. For material changes, we email you before they take effect. If you keep using whasp after that, you accept the new terms.
